Divorce Process in NJ

  • A currently married couple decides to move forward with divorce

  • They meet with a representative of Fairlight Mediation Services

  • Basic information is collected via a client information form completed by both clients

  • Our practice manager reviews the information and presents the clients with a flat rate fee for divorce mediation

  • The clients accept the flat rate fee and sign the Agreement to Mediate

  • A divorce mediator is assigned to the case and mediation times are scheduled

  • Once all issues are resolved to the satisfaction of the clients, the mediator will draft a Memorandum of Understanding (MOU)

  • The MOU is furnished to the clients.

  • It is recommended that the clients have the MOU reviewed by individual counsel

  • The clients can use the MOU for submittal to the court if they are representing themselves (pro se)

  • The MOU can be used as the basis of a Marital Settlement Agreement if represented by counsel.
